This website (the "Site") is owned and operated by My Temple Supplements, Inc., a Nevada corporation (“COMPANY” "we" or "us"). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, our Shipping Policy, our Return Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from COMPANY. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.
We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified.
What are your mobile terms?
When you provide us with your mobile phone number, you agree that My Temple Supplements may send you text messages (including SMS and MMS) to that phone number. You will receive a confirmation text message, and you may need to reply as instructed to complete registration. The frequency at which you'll receive our text messages may vary from month to month. Message and data rates may apply. Reply STOP to cancel, HELP for help. You agree to receive a final text message confirming your opt-out. You may opt-out at any time by texting the word STOP to the number [comp number]. For help, send a text message with the keyword HELP to the number [comp number]. Texts may be sent through an automatic telephone dialing system. Consent is not required to purchase our goods or services. You agree to notify us of any changes to your mobile number and update your account to reflect this change. Your carrier may prohibit or restrict certain mobile features and certain mobile features may be incompatible with your carrier or mobile device. Contact your carrier with questions regarding these issues.
How do I sign up for these text messages?
All you have to do is text join to [comp number]. (Message frequency may vary, message and data rates may apply, and you can always text HELP for help & STOP to cancel.) When you opt-in to the service, we will send you an SMS message to confirm your signup. If at any time you forget what keywords are supported, just text HELP to [comp number]. After you send the SMS message HELP to us, we will respond with instructions on how to use our service as well as how to unsubscribe.
How do I opt out of these text messages?
You can cancel the SMS service at any time. Just text STOP to [comp number]. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
Will I be charged for the text messages I receive?
My Temple Supplements will never charge you for the text messages you receive however standard message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. All matters regarding returns of My Temple Supplements Products must be conducted with place of purchase (www.mytemple.com, My Temple Supplements authorized reseller, etc.). Returning an My Temple Supplements ‘Product’ without complying with our policy, or returning a Product absent the protections afforded by My Temple Supplements as the retailer, or the protections conferred contractually to participants in the My Temple Supplements Authorized Reseller program will unfortunately deem your transaction non-refundable. My Temple Supplements defines ‘Product’ for the purpose of this policy as the sum of the following parts:
1. My Temple Supplements physical products (sealed bottles/containers containing unaltered My Temple Supplements product)
2. My Temple Supplements digital or marketing materials prescribed for distribution with the physical My Temple Supplements products, and
3. Warranty protections held by My Temple Supplements as the retailer or conferred by My Temple Supplements in contractual agreement to authorized resellers.
Products not containing the sum of its parts (products purchased from unauthorized resellers, who by definition, operate with no warranty protections that My Temple Supplements is contractually bound to honor for example) are defined by My Temple Supplements policy as ‘materially different’ from My Temple Supplements products sold to end users (customers) by My Temple Supplements or participants in My Temple Supplements’s authorized reseller program, and thus are not authorized for resell. Products resold by persons, parties or entities, not granted warranty protections in a mutual agreement with My Temple Supplements under My Temple Supplements’s Authorized Reseller Program are not authorized for reimbursement in the event of return under this policy. Warranty protections as granted by My Temple Supplements to authorized resellers cannot be purchased or transferred, and are held exclusively by My Temple Supplements, except as conferred through mutual agreement between My Temple Supplements and participants in My Temple Supplements’s Authorized Reseller Program.

Assignment
This Agreement shall be binding upon and inure to the benefit of COMPANY and our respective assigns, successors, heirs, and legal representatives. Neither this Agreement nor any rights hereunder may be assigned without the prior written consent of COMPANY Notwithstanding the foregoing, all rights and obligations under this Agreement may be freely assigned by COMPANY to any affiliated entity or any of its wholly owned subsidiaries.
Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Nevada and any dispute shall be subject to binding arbitration in Las Vegas, Nevada. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedure
These procedures are intended to increase the likelihood of prompt and low-cost resolutions to any dispute between the parties. All the requirements of the Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedure are jurisdictional in nature.
● Before a party commences an arbitration with NAM with respect to a claim, the party must first send a written notice of dispute (“Notice”). The Notice must (1) be sent by certified mail, return receipt requested or FedEx; (2) be addressed to: My Temple Supplements, Inc, 304 S. Jones Blvd #1878, Las Vegas, NV 89107 (3) contain the party’s name, address, email address and date/time of website visit; (4) include a short summary of the dispute, including any relevant facts regarding the use of the Products with specific relief sought;
● The party must attend a video conference to discuss the dispute with a representative from My Temple Supplements. The party’s attorney may be present;
● My Temple Supplements then shall have 45 days from the date of the video conference to analyze the nature of the dispute before the filing of an arbitration with NAM by the party.
● If any aspect of these requirements has not been met, a court of competent jurisdiction may enjoin the filing or prosecution of an arbitration. In addition, unless prohibited by law, NAM Arbitration Practice Administrator/Case Manager must dismiss any arbitration claims brought by a party that has failed to follow the required steps in the Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedure. If the arbitration is already pending prior to the completion of the Mandatory Pre-Arbitration Notice and Information Dispute Resolution Procedure, NAM cannot accept any fees in connection with an arbitration that has been initiated without completion of the Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedure. Nothing in this paragraph limits the right of My Temple Supplements to seek damages for non-compliance with the Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedure in arbitration.
● If after the Mandatory Pre-Arbitration Notice and Informal Dispute Resolution Procedure has been completed, any claim or dispute arising from use of the Products shall be settled only through binding arbitration. Any complaint or lawsuit filed in a court of law shall be dismissed and the arbitration shall commence. Nothing in this paragraph limits the right of My Temple Supplements to seek damages if a party files a complaint or lawsuit.
Class Action Waiver
You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren't allowed.
The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration.
Severability
If any clause within these Terms of Service (other than the Class Action Waiver clause above) is found to be illegal or unenforceable, that clause will be severed from these Terms of Service, and the remainder of these Terms of Service will be given full force and effect. If the Class Action Waiver clause is found to be illegal or unenforceable, this entire Provision will be unenforceable and the dispute will be decided by a court.
